Privacy Policy

Sampoll Inc. ("Sampoll," "we," "us," or "our") provides a digital product-sampling platform: we run product-trial campaigns for consumer brands ("Brands") in which shoppers claim an offer, buy the Brand's product at a retailer or through the Brand's online store, submit proof of purchase, and get reimbursed, plus related offer types such as coupon codes and sweepstakes.

This Privacy Policy describes how Sampoll processes personal information that we collect through our digital properties and services that link to this Privacy Policy, as well as our marketing activities and other activities described in this Privacy Policy (collectively, the "Service"). These properties include our marketing website (trysampoll.com), our shopper offer and redemption experience (offers.trysampoll.com), and Launchpad, our campaign platform for brands (launch.trysampoll.com).

1. Personal information we collect

Information you provide to us. Personal information you may provide to us through the Service or otherwise includes:

  • Contact data, such as your first and last name, email address, phone number, and mailing address (for example, when you claim a sweepstakes prize).
  • Demographic data, such as your city, state, ZIP code, age, and household information.
  • Profile data, such as your account details, product and grocery preferences, interests, preferred payout method, notification settings, and information about your participation in offers, contests, promotions, or surveys.
  • Communications data based on our exchanges with you, including your conversations with Sam (our conversational chat experience), support requests, and interactions on social media.
  • Redemption and transactional data, such as the offers you claim, the receipts and other proof of purchase you submit, your redemption history, your sweepstakes entries, and prize-claim details such as your shipping address.
  • Payout data needed to deliver your reimbursements and rewards, such as your PayPal, Venmo, or Cash App account identifiers, your bank account details for ACH transfers, or the email address where a gift card or prepaid card is delivered. This data is processed with our payment providers.
  • Promotion data, including the answers you give to qualification and Brand questions and information you share when you enter a sweepstakes or complete a survey. Sweepstakes and contests are voluntary. We recommend that you read the official rules of each sweepstakes you enter.
  • Brand-account data, if you create a Launchpad account for your brand: business contact details, company name, professional title, and billing information. Payment card data is collected directly by our payment processor.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as: identity providers (for example, Google) if you use them to sign in to the Service; data providers, such as IP-geolocation services; Brands and marketing partners, for example when a Brand directs you to its campaign; public sources; and business transaction partners in connection with an actual or prospective business transaction.

Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications, and other online services, such as:

  • Device data, such as your device's operating system type and version, browser type, screen resolution, device type, IP address, unique identifiers (including identifiers used for advertising purposes), language settings, and general location information such as city, state, or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths, access times, and whether you have opened our emails or clicked links within them.
  • Location data. We derive your general location (city and state) from your IP address, for example to show nearby participating retailers. We collect precise geolocation only if you grant your device's or browser's location permission, for example to power the store locator.
  • Communication interaction data, such as your interactions with our emails (for example, whether you open them or click links). We may collect this through pixel tags embedded in our emails.

Data about others. If a feature of the Service lets you refer a friend or share an offer with someone else, please do not share another person's contact details with us unless you have their permission to do so.

2. Tracking and other technologies

Cookies and similar technologies. Some of our automatic data collection is facilitated by cookies, log files, web beacons, pixels, and local storage. We use these technologies to operate the Service, remember your preferences, measure how the Service is used, and support advertising measurement. The tracking technologies the Service currently uses include:

  • Google Analytics and Google Tag Manager: site analytics and tag management. You can learn how to opt out of Google Analytics at tools.google.com/dlpage/gaoptout.
  • Meta Pixel and Conversions API: advertising and conversion measurement.
  • LinkedIn Insight Tag: advertising and conversion measurement.
  • Microsoft Clarity: session analytics that help us understand how shoppers use offer pages.

Chat and AI technologies. Sam, our conversational brand-ambassador experience, is an AI-powered chat feature that runs on the Landbot chat platform. When you chat with Sam, the messages and answers you share are processed by our chat providers to run the conversation on our behalf and are handled as described in this Privacy Policy.

3. How we use your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

Service delivery and operations. We may use your personal information to: provide the Service; establish and maintain your profile; run offers end to end, including qualifying your participation, showing you nearby participating retailers, verifying your proof of purchase, and delivering your reimbursements and rewards; administer sweepstakes, including winner selection, notification, and prize delivery; enable security features of the Service; communicate with you about the Service, including service-related announcements, updates, security alerts, and support messages; and respond to your requests, questions, and feedback.

Service personalization. We may use your personal information to understand your needs and interests, personalize your experience with the Service and our communications, and remember your selections and preferences.

Service improvement and analytics. We may use your personal information to analyze usage of the Service, improve the Service and the rest of our business, understand how visitors move around the Service, measure interactions with our emails, and develop new products and services.

Marketing and advertising. We may send you direct marketing communications and may personalize these messages based on your needs and interests. You may opt out of our marketing communications as described in the Your choices section. We, our service providers, and our advertising partners may also use information collected through tracking technologies to measure our advertising and serve ads that we or they think will interest you (interest-based advertising).

Events, promotions, and contests. We may use your personal information to administer promotions and sweepstakes and to communicate with you about promotions in which you participate.

Fraud prevention, compliance, and protection. We may use your personal information to verify receipts and redemption activity, enforce offer limits, and prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity; to comply with applicable laws, lawful requests, and legal process; to protect our, your, or others' rights, privacy, safety, or property; to audit our internal processes; and to enforce the terms and conditions that govern the Service.

Aggregated, de-identified, and anonymized data. We may create aggregated, de-identified, and/or anonymized data from personal information by removing information that makes the data identifiable to you, and we will not attempt to re-identify it. We may use this data and share it with third parties, including market research and insights partners, for our lawful business purposes, including analyzing and improving the Service and promoting our business.

Further uses. In some cases, we may use your personal information for further purposes. We will ask for your consent if those purposes are not compatible with the initial purpose for which the information was collected.

4. Retention

We generally retain personal information to fulfill the purposes for which we collected it, including satisfying legal, accounting, or reporting requirements, establishing or defending legal claims, and preventing fraud. To determine the appropriate retention period, we may consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and applicable legal requirements. When we no longer require the personal information we have collected about you, we may delete it, anonymize it, or isolate it from further processing.

5. How we share your personal information

We may share your personal information with the following parties, or as otherwise described in this Privacy Policy or at the time of collection:

Brands. When you engage with a Brand's offer (for example, when you claim it, chat with Sam about it, or redeem it), we share the personal information collected in that campaign with that Brand, with your consent. This includes your contact and demographic data, your answers to campaign questions, and your redemption activity, and it can include syncing that data to the Brand's CRM or marketing tools (such as Klaviyo, Salesforce, or HubSpot). Brands use this information for their own purposes, including marketing to you, under their own privacy policies.

Service providers. Third parties that provide services on our behalf or help us operate the Service or our business, such as hosting and infrastructure, chat platform providers, receipt-verification and fraud-detection services, analytics, email delivery, and customer support.

Payment providers. Reimbursements and rewards are delivered through payment providers such as PayPal, Venmo, Cash App, banks (for ACH transfers), and prepaid card and gift card issuers, which process your payout data in accordance with their own privacy policies. For Launchpad billing, payment card data is collected and processed directly by our payment processor.

Advertising partners. We may share hashed email identifiers and campaign event data with advertising platforms (such as Meta, Google, and LinkedIn) to measure our campaigns and improve the accuracy of event tracking. Hashing transforms the raw email address before it is shared. Some state privacy laws may treat this as a "sale" or "sharing" of personal information; see the State privacy rights notice for your opt-out options.

Market research and insights partners. We may share aggregated and/or de-identified data (data that does not identify you) with market research and insights firms, which may use it for their own purposes, including research and marketing.

Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so.

Linked third-party services. If you sign in to the Service with a third-party service such as Google, we may share information with that service as needed to operate the sign-in. The third party's use of that information is governed by its own privacy policy.

Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, in the course of the professional services they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the fraud prevention, compliance, and protection purposes described above.

Business transferees. We may disclose personal information in the context of actual or prospective business transactions (for example, investments in Sampoll, financing, or the sale, transfer, or merger of all or part of our business, assets, or shares), and to an acquirer, successor, or assignee of Sampoll as part of any such transaction, including in an insolvency, bankruptcy, or receivership.

6. Your choices

Access or update your information. If you have registered for an account through the Service, you may review and update certain information by signing in to your account.

Opt out of marketing communications. You may opt out of marketing-related emails by following the unsubscribe instructions at the bottom of the email or by contacting us. If you opt out of marketing emails, you may continue to receive service-related and other non-marketing emails, such as redemption and payout confirmations.

Cookies and tracking technologies. Most browsers let you remove or block cookies through your settings. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout and learn about interest-based advertising opt-outs at optout.aboutads.info.

Global Privacy Control. We honor Global Privacy Control ("GPC") signals as valid requests to opt out of the sale or sharing of personal information, as required by applicable law. When we detect a GPC signal from your browser, we treat it as a request to opt out of the sale or sharing of your personal information. Do Not Track. Some browsers can send "Do Not Track" signals. We do not respond to "Do Not Track" signals, but we do honor GPC signals as described above.

Precise location. You can disable our access to your device's precise location at any time in your device or browser settings.

Declining to provide information. We need to collect certain personal information to provide certain services. For example, we cannot verify a redemption without proof of purchase, and we cannot deliver a reimbursement without a payout destination. If you do not provide required information, we may not be able to provide those services.

Linked third-party platforms. If you sign in through a third-party platform such as Google, you may be able to use that platform's settings to limit the information we receive from it. Revoking access does not apply to information we have already received.

Delete your account. You can request deletion of your account by following the instructions on the Service or by contacting us at [email protected].

7. Other sites and services

The Service may contain links to websites, mobile applications, and other online services operated by third parties, including Brands' own storefronts and participating retailers. These links are not an endorsement of, or a representation that we are affiliated with, any third party. We do not control third-party websites or services and are not responsible for their actions. We encourage you to read the privacy policies of the other websites and services you use.

We employ technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.

9. International data transfer

We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.

10. Children

The Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a child without the consent of the child's parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.

11. Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you by updating the date of this Privacy Policy and posting it on the Service or by other appropriate means. Any modifications will be effective upon posting (or as otherwise indicated at the time of posting). Your use of the Service after the effective date of a modified Privacy Policy indicates that you acknowledge the modified Privacy Policy applies to your interactions with the Service and our business.

Except as otherwise provided, this section applies to residents of U.S. states to the extent they have privacy laws applicable to us that grant their residents the rights described below (collectively, the "State Privacy Laws").

This section describes how we collect, use, and share Personal Information of residents of these states and the rights those residents may have. Not all rights listed below may be afforded to all users, and if your state's laws do not apply to us, you may not be able to exercise these rights. We may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it. To confirm your identity, we will ask you to verify control of the email address associated with your account and may ask you for details about your activity on the Service.

For purposes of this section, "Personal Information" has the meaning given to "personal data," "personal information," or similar terms in the State Privacy Laws, and "Sensitive Personal Information" has the meaning given to "sensitive personal information," "sensitive data," or similar terms in the State Privacy Laws, except that neither term includes information exempted from the scope of those laws.

Your privacy rights. The State Privacy Laws may provide residents with some or all of the rights listed below. These rights are not absolute, and we may decline a request in certain cases as permitted by law.

  • Information. You can request information about how we have collected and used your Personal Information, including the categories collected, the sources, the purposes, and the categories of third parties with which we share it.
  • Access. You can request a copy of the Personal Information we have collected about you.
  • Appeal. You can appeal our denial of any request validly submitted.
  • Correction. You can ask us to correct inaccurate Personal Information.
  • Deletion. You can ask us to delete the Personal Information we have collected from you.
  • Opt out of targeted advertising. We may process Personal Information for targeted advertising purposes. You can opt out of that processing.
  • Opt out of sales. We do not sell Personal Information for money. However, our sharing of hashed email identifiers and event data with advertising partners may be treated as a "sale" or "sharing" under some State Privacy Laws. You can opt out as described below.
  • Profiling and automated decision-making. We do not use your Personal Information to make automated decisions that produce legal or similarly significant effects concerning you.
  • Sensitive Personal Information. We process certain categories of Sensitive Personal Information, namely precise geolocation (only with your permission) and account or payout details, to provide the Service. We do not process Sensitive Personal Information for the purpose of inferring characteristics about you.
  • Consumers under 16. We do not have actual knowledge that we collect, sell, or share the Personal Information of consumers under 16 years of age. The Service is intended for users 18 and older.
  • Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by the State Privacy Laws.

Exercising your right to opt out of "sale" or "sharing." You can submit a request to opt out of tracking for targeted advertising purposes or other sales or sharing of Personal Information through our support page at trysampoll.com/sam-support, by email to [email protected], or by broadcasting the Global Privacy Control signal from your browser. We honor GPC signals as valid opt-out requests for the sale or sharing of Personal Information, as required by applicable law.

Exercising your other rights. You may submit requests to exercise any of the other rights listed above through our support page at trysampoll.com/sam-support or by email to [email protected].

Authorized agents. Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf. We may need to verify your agent's identity and authority to act for you, and we may require a copy of a valid power of attorney or ask you to confirm in writing that you have authorized the agent's request.

Information practices. The following describes our practices currently and during the past 12 months. We collect the categories of Personal Information described in the Personal information we collect section from the sources and for the purposes described in this Privacy Policy. Our retention criteria are described in the Retention section. We do not attempt to re-identify de-identified information, except to test whether our de-identification processes comply with applicable law.

Additional information for California residents: Shine the Light. Under California's Shine the Light law (California Civil Code Section 1798.83), California residents may ask companies with whom they have a business relationship primarily for personal, family, or household purposes for the names of third parties to which the company has disclosed certain personal information during the preceding calendar year for those third parties' own direct marketing purposes, and the categories of information disclosed. You may send us requests for this information to [email protected]. Your request must include the statement "Shine the Light Request," your first and last name and mailing address, and a certification that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency.

Additional information for Nevada residents. Nevada residents have the right to opt out of the sale of certain personal information for monetary consideration.
